General Terms and Conditions (GTC)
Private Aviation Care
As of October 19, 2026
§ 1 Scope of Application
These General Terms and Conditions (GTC) apply to all offers, contracts, and services provided by Private Aviation Care, owned by Finn de Gelder, hereinafter referred to as the “Service Provider.”
Our services are aimed at both individual customers (consumers) and business customers (business owners).
Consumers are natural persons who enter into a contract primarily for purposes that are not attributable to their commercial or self-employed professional activities.
Businesses are natural persons or legal entities that, at the time a contract is concluded, are acting in the course of their commercial or self-employed professional activities.
Individual agreements take precedence over these Terms and Conditions.
Mandatory statutory consumer protection provisions remain unaffected.
§ 2 Services and Scope of Services
Private Aviation Care offers professional cleaning, maintenance, and detailing services for private and business aircraft.
Our range of services includes, in particular:
Aircraft Interior Detailing
Exterior Dry Wash
Exterior Wet Wash
Carpet Shampooing & Extraction
Leather Cleaning & Conditioning
Stain Removal
Waterless Aircraft Cleaning
Paint Restoration
Customized cleaning and maintenance services
The exact scope of services is determined individually for each order and described in the respective quote.
Services not expressly agreed upon are not part of the contract.
Maintenance work, technical repairs, inspections, and aviation certifications are not included in our services.
A specific visual result is only guaranteed if it has been expressly agreed upon. Statutory rights in the event of defective performance remain unaffected.
§ 3 Requests for Quotes and Conclusion of Contracts
All services are provided exclusively on the basis of a customized quote.
Inquiries made through our website, by email, by phone, or through other communication channels do not constitute a binding reservation.
Upon receipt of a request, Private Aviation Care prepares a customized quote that takes into account the requested services, the aircraft, the location, and the estimated workload.
Unless otherwise specified, our offers are valid for 14 calendar days from the date of issuance.
A contract is formed when the client accepts our binding offer within the validity period or when we expressly confirm a corresponding order.
To the extent permitted by law, acceptance may be made in writing, such as by email.
Changes or additional services require a separate agreement.
Before the contract is concluded, the client will have the opportunity to review and save these Terms and Conditions.
§ 4 Condition of the Aircraft and Prior Damage
The client must inform Private Aviation Care of any known damage, sensitive materials, technical specifications, and relevant restrictions before work begins.
These include, in particular:
Existing paint damage and scratches
Corrosion and Material Fatigue
Damaged or loose components
Delicate Coatings
Damaged Seals
Discoloration and existing stains
Interior components that are already damaged
Private Aviation Care can document the condition of the aircraft before work begins using photographs and a condition report, provided the necessary approvals have been obtained.
Private Aviation Care assumes no liability for damages that can be proven to have existed prior to the commencement of work or that were not caused by an attributable breach of duty on the part of Private Aviation Care.
If damage or specific risks are identified during the work, the affected work may be suspended until the matter is resolved.
The client's statutory rights remain unaffected.
§ 5 Sensitive Materials and Cleaning Risks
Aircraft often have high-quality, delicate, and specially treated surfaces.
Private Aviation Care takes into account the applicable manufacturer, material, and safety specifications when performing its work.
Pre-existing material damage, signs of aging, discoloration, or deeper damage may affect the cleaning results that can be achieved.
We do not guarantee the complete removal of all scratches, stains, discoloration, or signs of wear, unless such a result has been expressly agreed upon.
If there are identifiable risks, Private Aviation Care may refuse treatment or adjust it after consulting with the client.
Statutory liability for damages caused by negligence remains unaffected.
§ 6 Liability and Limitation of Liability
Private Aviation Care is liable for damages caused by willful misconduct or gross negligence in accordance with statutory provisions.
Liability for damages resulting from injury to life, body, or health, as well as other mandatory statutory liability, remains unlimited.
With respect to business entities, liability for a breach of material contractual obligations due to slight negligence is limited, to the extent permitted by law, to damages typical for the contract and foreseeable at the time the contract was concluded.
With respect to business entities, liability for slightly negligent breaches of non-essential contractual obligations is excluded to the extent permitted by law.
With respect to consumers, the mandatory statutory liability provisions apply. Limitations on liability apply only to the extent that they are valid under the applicable law.
Private Aviation Care assumes no liability for damage that can be proven to have already existed, normal wear and tear, natural aging of materials, or damage not caused by an attributable breach of duty on the part of Private Aviation Care.
With respect to business customers, liability for lost profits, loss of use, flight delays, flight cancellations, costs of alternative flights, and other indirect economic losses is excluded to the extent permitted by law.
These Terms and Conditions do not provide for any limitation of liability with respect to the amount of damages. Such a limitation requires a separate, legally binding agreement.
Mandatory statutory liability provisions and statutory claims arising from defective performance remain unaffected.
§ 7 Aviation Safety and Technical Restrictions
Our services are limited to the agreed-upon cleaning and cosmetic maintenance of aircraft.
Private Aviation Care does not perform any aviation maintenance, repair, or certification work.
Work on safety-related components, sensors, electrical systems, and other critical areas may only be performed to the extent that it has been expressly agreed upon, is legally permissible, and is covered by the necessary specifications.
The client shall provide the information necessary for the agreed-upon work and any available manufacturer's instructions.
Private Aviation Care is entitled to refuse or suspend work if safety risks exist or if required approvals are lacking.
§ 8 Airport Locations and Access Authorizations
Our services are provided at individually agreed-upon airport locations.
The parties shall agree in advance on who will arrange the necessary access authorizations, permits, and, if applicable, any required escorts.
The work will be carried out in compliance with applicable airport, safety, and operational regulations.
If work cannot be performed due to a lack of permits, limited access, or company directives, an alternative date will be scheduled whenever possible.
Additional costs will be charged only in accordance with the contractual agreements and statutory provisions.
§ 9 Weather Conditions and Force Majeure
Certain services are dependent on suitable weather and environmental conditions.
In the event of frost, strong winds, thunderstorms, extreme temperatures, or other safety hazards, work may be postponed or suspended.
In the event of force majeure, the statutory provisions shall apply.
Partial services that have already been properly rendered will be billed in accordance with the contractual and statutory provisions.
The client's statutory rights remain unaffected.
§ 10 Prices and Payment Terms
All prices are determined individually in each quote.
For consumers, total prices are listed, including applicable sales tax and all mandatory price components.
For business customers, net prices plus the applicable sales tax may be listed, provided this is clearly indicated.
Additional services, travel expenses, or special costs will be agreed upon in advance.
Invoices are due within 14 calendar days of receipt, unless otherwise agreed upon on a case-by-case basis.
Any down payment that may have been agreed upon will be expressly stated in the respective quote.
In the event of late payment, the statutory provisions apply.
Payments are made using the payment methods listed on the invoice.
§ 11 Cancellations and Schedule Changes
Scheduled appointments may be rescheduled by mutual agreement.
Cancellations should be communicated in writing as early as possible.
The consequences of a cancellation depend on the specific terms of the contract and applicable laws.
Costs already incurred or statutory claims for compensation may be asserted only to the extent that there is a corresponding legal basis for doing so.
Consumers' statutory rights of withdrawal remain unaffected.
§ 12 Right of Withdrawal for Consumers
Consumers may have a statutory right of withdrawal for distance sales contracts or contracts concluded outside of business premises.
To the extent that a statutory right of withdrawal applies, the consumer will receive separate instructions regarding the right of withdrawal and, if applicable, a sample withdrawal form prior to the conclusion of the contract.
If, at the consumer’s express request, a service is to begin during the cancellation period, the statements required by law for this purpose will be obtained.
The conditions for a potential claim for reimbursement and for the expiration of the right of rescission are governed by the applicable statutory provisions.
These Terms and Conditions do not replace the legally required cancellation policy.
§ 13 Acceptance and Complaints
Upon completion of the work, the client will be given the opportunity to review the services rendered, to the extent that this is logistically feasible.
Complaints should be reported as soon as possible so that they can be properly investigated.
Statutory rights regarding defective services remain unaffected.
Any subsequent performance shall be governed by the provisions of law.
§ 14 Personal Belongings and Valuables
The client is asked to secure personal valuables, confidential documents, and loose items before work begins.
Personal belongings will be stored separately only if expressly agreed upon.
Private Aviation Care's statutory liability for damages caused by it remains unaffected.
§ 15 Photo and Video Documentation
Photos and videos may be taken to document the initial condition and the work performed, to the extent permitted by law.
Publication for advertising purposes will only take place with the necessary approvals or consents.
Security regulations, confidentiality agreements, and data protection provisions are taken into account.
§ 16 Confidentiality and Data Protection
Private Aviation Care treats non-public information regarding aircraft, owners, passengers, flight operations, and operational procedures as confidential.
Data will only be disclosed to the extent that it is necessary for the performance of the contract, legally permissible, or required by law.

§ 17 Governing Law and Jurisdiction
As a general rule, Dutch law applies to contractual relationships, provided that a valid choice of law has been agreed upon.
With respect to consumers, mandatory consumer protection provisions of the country of their habitual residence remain applicable to the extent required by law.
For disputes with business entities, to the extent permitted by law, the parties agree that the courts in the Netherlands with subject-matter jurisdiction shall have jurisdiction.
For consumers, the statutory rules governing the venue of litigation apply.
§ 18 Final Provisions
Individual agreements take precedence over these Terms and Conditions.
If any provision of these Terms and Conditions is invalid, the remaining provisions shall remain valid to the extent permitted by law.
